Welcome to Wicked Keys™.

These Terms of Service govern your use of wickedkeys.com.au and the digital products, sheet music, courses, educational resources, memberships and other services provided by Wicked Keys.

Wicked Keys™ is operated by James Anthony Baker trading as Wicked Keys, an Australian sole trader, ABN 59 048 672 013.

By accessing our website, creating an account, starting a free trial or purchasing a membership, you agree to these Terms of Service.

1. Wicked Keys Memberships

Wicked Keys provides access to digital sheet music, courses, educational materials and other resources through paid memberships.

The content available to you depends on your membership type and may change as Wicked Keys adds, updates or removes resources.

Your membership provides you with a limited licence to access and use the resources included with your membership. Purchasing a membership does not transfer ownership or copyright in those resources to you.

2. Learner Memberships

A Learner membership is licensed for personal use by one individual only.

Learner members may access and use resources included with their membership for their own personal learning and educational purposes.

Unless expressly stated otherwise, Learner members may not:

• share their account or membership access with another person;
• distribute Wicked Keys resources to another person;
• reproduce resources for use by students, classes, schools or studios;
• upload or distribute resources online;
• sell, sublicense or commercially distribute Wicked Keys resources; or
• make Wicked Keys resources available to anyone who is not authorised under their membership.

3. Teacher Memberships

A Teacher membership provides a limited studio licence for use by one individual teacher and their direct students.

While a Teacher membership is active, the Teacher member may print, reproduce and share eligible Wicked Keys resources with students they personally teach where this is reasonably required for lessons and educational use.

This licence applies only to the individual teacher who holds the membership and their direct students.

A Teacher membership does not permit resources to be:

• shared with other teachers;
• shared between multiple teachers within a school, studio or organisation;
• uploaded to publicly accessible websites, social media, file-sharing services or online resource libraries;
• sold, sublicensed or redistributed;
• incorporated into another commercial publication, course, teaching resource or product; or
• otherwise distributed outside the member's own direct teaching activities.

Separate teachers must hold their own appropriate Wicked Keys membership unless Wicked Keys has expressly agreed to another licensing arrangement in writing.

4. Membership Licence Period

Membership licences remain valid only while the applicable Wicked Keys membership is active.

If you cancel your membership, your access and licence continue until the end of your current paid membership period.

When your membership expires, your right to access and use membership-only Wicked Keys resources ends.

For Teacher members, the right to reproduce or distribute Wicked Keys resources to students also ends when the Teacher membership expires.

Resources previously provided to a student in accordance with an active Teacher membership do not need to be physically retrieved or destroyed when the membership ends. However, the former member may not make new copies, distribute additional resources or continue using the Wicked Keys library under the Teacher licence after expiry.

5. Accounts

Your Wicked Keys account is personal to you.

You are responsible for maintaining the security of your account and login details. You must not share your login credentials or allow another person to use your account to access membership content.

You must provide accurate and current information when creating and maintaining your account.

If you believe your account has been accessed without permission, please contact us.

6. Billing and Automatic Renewal

Wicked Keys memberships are available on monthly or annual billing cycles.

Memberships automatically renew at the end of each billing period unless cancelled before renewal.

By purchasing a membership, you authorise us and our payment providers to charge your selected payment method for each renewal until your membership is cancelled.

Current membership prices and billing frequencies are displayed before you subscribe.

7. Free Trials

Where offered, Wicked Keys memberships may include a 7-day free trial.

A valid payment method may be required to begin a free trial.

Unless you cancel before the trial ends, your membership will automatically convert to a paid membership and your selected payment method will be charged according to the membership and billing cycle selected when you started the trial.

The membership will then continue to renew automatically until cancelled.

8. Cancellation

You may cancel your membership at any time.

Cancellation prevents your membership from renewing at the end of the current billing period. You will continue to have access to the content included with your membership until that period ends.

Your access and applicable membership licence will expire at the end of the current membership period.

9. Refunds

Membership payments are non-refundable for change of mind, accidental subscription, failure to use the membership, or cancellation during a billing period.

Cancellation stops future renewals but does not provide a refund for the remaining portion of the current billing period.

Nothing in these Terms excludes, restricts or modifies any rights or remedies available to you under the Australian Consumer Law or any other applicable law that cannot legally be excluded.

10. Copyright and Intellectual Property

Unless otherwise stated, the Wicked Keys website, sheet music, musical arrangements, original compositions, recordings, backing tracks, courses, exercises, lesson materials, graphics, text, videos, audio, software, branding and other original materials are owned by or licensed to Wicked Keys and are protected by applicable copyright, trade mark and intellectual property laws.

Wicked Keys™ and associated branding remain the property of Wicked Keys.

Where Wicked Keys publishes an original arrangement of a public domain composition, copyright is claimed only in the original arrangement and other original material created by Wicked Keys, and not in the underlying public domain composition.

No ownership or copyright is transferred to a member through membership, access, downloading, printing or use of Wicked Keys resources.

Your rights to use our resources are limited to the licence applicable to your membership and these Terms of Service.

Except where expressly permitted by these Terms or by law, Wicked Keys content may not be copied, reproduced, republished, uploaded, transmitted, distributed, sold, sublicensed, modified for redistribution, or incorporated into another publication, product or commercial resource without prior written permission from Wicked Keys.

You may not remove or obscure copyright notices, licence information, watermarks or other ownership information contained within Wicked Keys resources.

11. Sheet Music, Audio and Educational Resources

Wicked Keys resources are provided for educational, practice and performance purposes subject to the licence associated with your membership.

Individual resources may contain additional copyright or licensing information. Where an individual resource contains specific licence conditions, those conditions apply in addition to these Terms.

Some Wicked Keys resources may incorporate public domain works, licensed material or other third-party material. Rights in those underlying works remain with their respective owners where applicable.

12. Prohibited Use

You must not use Wicked Keys, your account or our resources:

• for any unlawful purpose;
• in a way that infringes our intellectual property rights or the rights of another person;
• to obtain or distribute Wicked Keys resources outside the licence provided by your membership;
• to share, resell or commercially redistribute membership content;
• to circumvent access controls, membership restrictions or technical protections;
• to interfere with the operation or security of our website or services;
• to introduce malicious software or harmful code; or
• to access our systems or content using unauthorised automated methods.

13. Suspension or Termination

We may suspend or terminate access to Wicked Keys where we reasonably believe an account is being used fraudulently, unlawfully or in material breach of these Terms, including account sharing or unauthorised distribution of Wicked Keys resources.

Where appropriate, we may contact you before taking action and provide an opportunity to resolve the issue.

Termination of an account does not affect any rights or obligations that arose before termination.

14. Availability of the Service

We aim to keep Wicked Keys and its digital resources available and functioning reliably, but we cannot guarantee uninterrupted or error-free access.

Access may occasionally be interrupted for maintenance, technical problems, security issues or circumstances outside our reasonable control.

We may update, replace, add or remove individual resources and features as Wicked Keys develops.

Where a significant change materially affects a paid membership, we will comply with any obligations imposed by applicable law.

15. Third-Party Services

Wicked Keys uses third-party platforms and service providers to operate parts of our website, payments, memberships and digital services.

We may also provide links to third-party websites or resources.

Third-party services may be governed by their own terms and privacy policies. We are not responsible for independent third-party websites, content or services except to the extent required by applicable law.

16. Educational Information

Wicked Keys provides music education resources and materials intended to support learning and teaching.

Our resources do not guarantee any particular educational, professional, examination or performance outcome.

Teachers remain responsible for determining whether particular materials and teaching approaches are appropriate for their individual students.

17. Privacy

Our collection and handling of personal information is governed by our Privacy Policy.

By using Wicked Keys, you acknowledge that personal information will be handled as described in that policy.

18. Liability and Consumer Rights

To the maximum extent permitted by law, Wicked Keys is not liable for indirect, incidental or consequential loss arising from your use of, or inability to use, our website, membership or digital resources.

Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy available under the Australian Consumer Law or any other applicable law that cannot legally be excluded or limited.

Where legislation implies a guarantee, condition or warranty that cannot legally be excluded, these Terms operate subject to that legislation.

19. Indemnity

To the extent permitted by law, you agree to indemnify Wicked Keys against reasonable losses, liabilities or expenses arising directly from your unlawful use of the Services, your infringement of another person's rights, or your material breach of these Terms.

20. Changes to Memberships and Pricing

We may change our membership offerings, features and pricing from time to time.

Changes to pricing will not retrospectively alter amounts already paid for a current billing period.

Where a price change affects an existing membership renewal, we will provide any notice required by applicable law before the new price takes effect.

21. Changes to These Terms

We may update these Terms of Service from time to time to reflect changes to Wicked Keys, our memberships, our services or applicable law.

The current version will be published on our website with its last updated date.

Where required by law, we will provide appropriate notice of material changes.

22. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to apply.

23. Governing Law

These Terms of Service are governed by the laws of New South Wales, Australia.

Nothing in this section limits any rights you may have under mandatory consumer laws that apply in your location.
